Terms of Service
Last Updated: September 2026
1. Introduction
Welcome to Oh Got It! ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and digital marketplace. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
2. Nature of the Service
Oh Got It! is an online venue that allows registered third-party sellers ("Sellers") to list and sell digital goods, software, templates, 3D models, and other digital assets ("Digital Goods") to buyers ("Buyers").
Intermediary Status: We act solely as an intermediary service provider. We are not the creator, owner, or distributor of the Digital Goods sold by Sellers. The contract for sale is directly between the Buyer and the Seller. While we may facilitate the transaction through third-party payment processors (such as Stripe), we assume no liability for the quality, safety, legality, or exactness of the Digital Goods listed.
3. User Accounts
To purchase or sell items on the Platform, you must register for an account. You must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
4. Intellectual Property & DMCA
We respect the intellectual property rights of others. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).
- For Sellers: You warrant that you own or have the necessary licenses, rights, and permissions to sell the Digital Goods you list.
- Reporting Infringement: If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a DMCA takedown notice to our designated Copyright Agent.
- Repeat Infringers: We terminate, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Platform for any illegal purpose or in violation of any local, state, national, or international law.
- Uploading or distributing viruses, malware, or any other malicious code.
- Attempting to reverse engineer, decompile, hack, or compromise the security of the Platform.
- Using automated systems (bots, spiders, scrapers) to access or collect data from the Platform without our explicit written consent.
- Engaging in fraudulent transactions or "friendly fraud" chargebacks.
6. Purchases and Refunds
Because the goods sold on the Platform are digital and instantly accessible, all sales are generally considered final. Refunds are granted strictly at the discretion of the Seller, subject to the Seller's individual store policies.
However, if a Digital Good is materially defective, misdescribed, or contains malicious code, the Buyer may escalate a dispute to Platform moderation. We reserve the right, but not the obligation, to unilaterally issue a refund and deduct the amount from the Seller's account balance.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE PLATFORM.
Under no circumstances will we be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the service or your account.
8. Indemnification
You agree to defend, indemnify, and hold harmless the Platform and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Platform; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
9. Modifications to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
